TERMS AND CONDITIONS OF USE
1. Agreement. This Agreement (the “Agreement”) specifies and describes the Terms and Conditions for access to and use of the Empower Wholeness Course and any related services (the “Course”), Empower Wholeness Services (the "Service"), and Empower Wholeness mentorships (the "Mentorship"). This Agreement may be modified at any time upon posting of the modified agreement. Any such modifications shall be effective immediately. You can view the most recent version of these terms at any time at https://www.empowerwholeness.com. Each purchase by you shall constitute and be deemed your unconditional acceptance of this Agreement.
2. Privacy. Your visit to our site is also governed by our Privacy Policy, which is viewable at https://www.empowerwholeness.com/.
3. Ownership. All content included in any course or service is and shall continue to be the property of Empower Wholeness, LLC (“Owner”) or its content suppliers and is protected under applicable copyright, trademark and other proprietary rights. Any copying, redistribution, use or publication by you of any such content or any part of the Course, Servicee, or Mentorship is prohibited, except as expressly permitted in this Agreement. Under no circumstances will you acquire any ownership rights or other interest in any content by or through your use of this Course, Service, or Mentorship.
4. Intended Audience. Course are intended for adults only. No Course is intended for any person under the age of 18.
5. Intellectual Property. Owner retains all rights to any intellectual property contained in and associated with the Course, the Service, or the Mentorship. All trademarks and copyrights applicable to content in any Course, Service, Mentorship, and the marketing thereof, is retained by Owner.
6. Compliance with Laws. You agree to comply with all applicable laws regarding your purchase and use of the Course, Service, or Mentorship. You further agree that information provided by you relating to your purchase of the Course, Service, or Mentorship is truthful and accurate to the best of your knowledge.
7. Indemnification. You agree to indemnify, defend and hold Owner and its members, partners, employees, affiliates, and partners harmless from any liability, loss, claim and expense, including reasonable attorney’s fees, related to your violation of this Agreement or use or purchase of the Course, Service, or Mentorship.
8. Payment and Refund Policy. The Course, Service, or Mentorship is offered on a “use it or lose it” basis. A purchaser’s failure to use the Course, Service, or Mentorship and all that it offers within the stated Course, Service, or Mentorship duration period will not result in a refund of any kind.
9. Payment Processing. You agree that all Course, Service, or Mentorship payment(s) are to be made out to and charged by Empower Wholeness, LLC.
10. Links or Offers. The Course, Service, or Mentorship materials may contain links or offers from third parties. Owner may receive commissions or financial incentives from Your use of any and all referrals, links, and offers contained in the Course, Service, or Mentorship materials.
11. Community Guidelines. This Course, Service, or Mentorship is intended to promote a community of inclusion, respect, and dignity. No hate speech or conduct will be tolerated by any purchaser of the Course, Service, or Mentorship. Additionally, Course, Service, and Mentorship purchasers agree not to sell their own courses or offers, or to promote products or credit cards to the Course, Service, or Mentorship community unless granted express permission by Owner. Course, Service, and Mentorship purchasers agree not to make any statements against Owner that could be deemed defamatory, and that could become grounds to deny You future access to Course, Service, or Mentorship materials.
12. Right to Deny Access. Any member, partner, or employee of Owner reserves the discretionary right to revoke access, without refund, to any person whose conduct does not conform to the Community Guidelines.
13. Disclaimer.
THE INFORMATION IN THE COURSE, SERVICE, OR MENTORSHIP IS PROVIDED ON AN “AS IS” BASIS. ALL INFORMATION IN THE COURSE, SERVICE, OR MENTORSHIP IS PROVIDED FOR EDUCATIONAL PURPOSES ONLY. OWNER DISCLAIMS ALL WARRANTIES OF ANY KIND, INCLUDING BUT NOT LIMITED TO ANY EXPRESS WARRANTIES, STATUTORY WARRANTIES, AND ANY IMPLIED WARRANTIES OF: MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. TO THE EXTENT YOUR JURISDICTION DOES NOT ALLOW LIMITATIONS ON WARRANTIES, THIS LIMITATION MAY NOT APPLY TO YOU. YOUR SOLE AND EXCLUSIVE REMEDY RELATING TO YOUR USE OF THE SITE SHALL BE TO DISCONTINUE USING THE SITE.
14. Limitation of Liability.
UNDER NO CIRCUMSTANCES WILL OWNER BE LIABLE OR RESPONSIBLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL (INCLUDING DAMAGES FROM LOSS OF BUSINESS, LOST PROFITS, LITIGATION, OR THE LIKE), SPECIAL, EXEMPLARY, PUNITIVE, OR OTHER DAMAGES, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN ANY WAY RELATING TO THE COURSE, SERVICE, OR MENTORSHIP, YOUR USE OF THE COURSE, SERVICE, OR MENTORSHIP, OR THE CONTENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. YOUR SOLE REMEDY FOR DISSATISFACTION WITH THE SITE AND/OR CONTENT IS TO CEASE ALL OF YOUR COURSE, SERVICE, OR MENTORSHIP USE.
You may have additional rights under certain laws (including consumer laws) which do not allow the exclusion of implied warranties, or the exclusion or limitation of certain damages. If these laws apply to you, the exclusions or limitations in this Agreement that directly conflict with such laws may not apply to You.
15. Click at Your Own Risk. YOU AGREE THAT USE OF THE COURSE, SERVICE, OR MENTORSHIP IS AT YOUR SOLE RISK. You agree that by clicking to purchase or subscribe to the Course, Service, or Mentorship you assume the risk of injury that you may suffer as a result of taking part in the activities described therein. You agree that you will not hold Owner liable for personal injury that is the result of non-negligent conduct attributable to Owner. You agree and understand that Owner is not licensed a physician or psychologist, and Owner does not provide clinical counseling, nor does it diagnose or treat any medical or mental health conditions or disorders.
16. Applicable Law and Venue. You agree that the laws of the state of California, without regard to conflicts of laws provisions will govern these Terms and Condition of Use and any dispute that may arise between You and Owner. Any litigation arising from this Agreement or Your use of the Site shall be venued in San Bernadino County, California.
17. Severability. If any provision of this Agreement shall be adjudged by any court of competent jurisdiction to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that this Agreement will otherwise remain in full force and effect. 18. Termination. Owner may terminate this Agreement or the website at any time, with or without notice, for any reason.
